The Respected Head of the Judiciary,

Greetings,

I, MITRA KADIVAR, MD., and the only Iranian psychoanalyst, a member of the World Psychoanalytic Association (with a special advisory position in the United Nations), would like to respecfully inform you  that six female members of the Freudian Association were arrested on their research trip to Mazandaran province on 08/09/2023 without an arrest warrant and were imprisoned without a valid detention order. A detention order with no number, no case number, no archive number and with a validity of 30 days. The objection to the order was denied by the respected judge of the Revolutionary court. Furthermore, the aforementioned order was issued by an assistant prosecutor outside the prosecutor’s office at an unknown place and after office hours!! I hereby kindly request you to order Mazandaran judiciary Province to provide a response to the following questions:

۱.How has an assistant prosecutor issued a detention order? Is an assistant prosecutor legally allowed to issue such orders?

۲.Why and based on which preliminary report was the order made?

۳.If there has been a preliminary report, why have they not been arrested in Tehran? If there is no preliminary report, what is the reason for the unlawful arrest? And for six people at that.

۴.Why were the 24 hours of initial detention from 5:30 pm on Friday 08/09/2023 to 5:10 pm on 09/09/2023 (the time of transfer to Qaemshahr prison) removed? The date of arrest and the date of being sent to prison are mentioned on 09/09/2023.

۵.What entity was liable for the initial arrest?

۶.Is it possible to arrest 6 educated women at a historical site on the evening of Friday, 08/09/2023, and interrogate them at an unknown location by unidentified persons(?), with an “oral order” that has been obsolete in the judiciary system for years, seize and search all their properties without order, keep them in the detention center overnight without a warrant, until the evening of 09/09/2023 at the same unknown location, interrogate them again via unidentified persons who refuse to send them to the prosecutor’s office and transferred to prison?

۷.Which law prohibits informing the lawyer and the family of the arrested up to 40 hours after the arrest? Even after entering the prison, according to the order of the assistant prosecutor of the case, they were prevented from contacting their lawyer and family until the morning of 10/09/2023.

۸.Why were 6 well-armed officers and 10 plainclothes officers sent to arrest 6 educated women in a historical site?

۹.What crime was committed in Mazandaran Province leading to this arrest?

۱۰.Why was this 30-day temporary detention for 6 educated women carried out in this manner when the chief justice has declared that there is no temporary detention in the judicial system, rather, other alternative sentences?

۱۱.The mechanism of accusation against a legal person is clear in the law. The Freudian Association and its belongings, including the official website of the association, is a legal entity and its office is located in Tehran. Why have natural  persons been arrested in the Amreh village- Sari with regards to accusations related to a legal entity?

۱۲.Why was the result of the investigators’ investigation not included in the case file before rejecting the objection to the order of temporary detention in the court due to defects in the investigation?

۱۳.Why was the arrest of 6 educated women carried out first and then they thought of making accusations along with confiscating and searching personal belongings and mobile phones without a warrant?

۱۴.Why were they sent to prison when neither the file number, nor the archive number, nor the order number were mentioned in inmate’s status?

۱۵.Most importantly, why does the Assistant Prosecutor of Branch 5 of the Sari courthouse think that the Ministry of Intelligence, the Intelligence Organization of the Islamic Revolutionary Guard Corps and the Ministry of Interior should be blamed for not being able to discover the repeated crimes committed for ten years which the resident Sherlock Holmeses at the security police of Sari was able to find within 24 hours “after” arresting those women?!!!
